OUR POLICY

Due to the nature of this website as an ecommerce shop, anytime you purchase an item, either paid or free, the information you provide during the checkout process is stored for future reference and legal protection of the Personal Use License granted to you by Alexis Giostra & Charmed Media Enterprises LLC (see Personal Use License Agreement for details). By default, the ecommerce system used in this shop asks for your Name, Address, Email & Telephone Number. This information is required to properly issue your Personal Use License, and to transmit the files to you as the buyer. Any deliberate attempts to provide misleading or false contact details does not exclude you from the Personal Use License and may result in the termination of your account, withdrawal of your access to purchases without warning or refund, and in extreme circumstances, legal action against you.

You have the option during checkout, to create an account in our shop or to checkout as a guest. When you create an account, the system will save your details and your digital purchases in a personal account for your reference for the period of one year, and to make the checkout process easier for you in the future. When you create an account, your password remains private, however, a system administrator has the power to generate a new password for your account but will only do so upon your request. If you checkout as a guest, your information is still collected by the system, but no account is created for you. During checkout you can also opt-in or out of our marketing emails; by default you are opted in, however, you can remove yourself from from our marketing email list by unsubscribing via the link at the bottom of these emails or by sending an email to me by clicking here. If at anytime you would like to review or correct the information stored pertaining to you, you can do so within your account or by email request. Although it is impossible to guarantee the security of information transmitted online entirely, all information stored on this site follows industry standards and practices. All data and information is stored on an SSL Certified Encrypted Cloud-Based Server that is monitored by professionals at BlueHost.com. All payments are securely processed through PayPal or Stripe and your financial information is never visible or transmitted to this site. Click here to view Paypal’s Privacy Policy. Be aware that Alexis Giostra & Charmed Media Enterprises LLC does not engage in the practice of selling customer information, but reserves the right to disclose your information if required by law or if you violate the terms outlined within this policy. If you believe your information has been compromised by our site, please email me immediately to address and rectify the situation.

All products sold in this ecommerce shop are digital and/or virtual services. No physical products will be mailed to your home address, and all shop related contact will be made via email to the email address you have provided during checkout. If at anytime you believe you have entered incorrect email information preventing you from receiving your purchases or accessing your account, please click here to send me an email and I will correct the information.

VIRTUAL SERVICES

Certain products within this shop include an element of virtual service and include an appropriate disclaimer within their listings. By purchasing these products and engaging in the virtual services provided by Alexis Giostra, clients understand and acknowledge that their decisions involve risks and uncertainty and there is no guarantee that any advice or recommendations made during the course of their service will always be correct or successful. By engaging in these services, the client agrees to hold Alexis C Giostra & Charmed Media Enterprises harmless in connection with this relationship.

The creator of these products, Alexis Giostra, is not a licensed financial advisor, mental health professional or certified “expert” of any kind. PERSONAL USE LICENSE AGREEMENT

Due to the digital nature of the products within this shop, when you make a purchase, you are entering into a Personal Use License Agreement with Alexis Giostra and Charmed Media Enterprises, LLC for use of the file, as well as any and all information transmitted to you through it. Once a digital product or file has been transmitted to and downloaded by you as the buyer, you have continuous access to the file through the agreement outlined below. If you do not receive your files promptly after purchase or misplace your download links, please notify Alexis immediately via email to receive them. If you misplace or fail to download your digital files within 90 days, or another reasonable period of time depending on the product, Alexis and Charmed Media Enterprises, LLC reserves the right to distribute or withhold files on a case by case basis.

AGREEMENT

Charmed Media Enterprises, LLC (“Content Provider”) grants buyer a non-exclusive *perpetual personal-use license to download and copy the accompanying files and images (collectively, “Media,”) subject to the following restrictions:

    • 1. This license is for personal use only. Personal use means non-commercial use of the Media for display on personal devices or making image prints or paper copies for personal use. The Media may not be used in any way whatsoever in which you charge money, collect fees, or receive any form of remuneration. The Media may not be used in advertising. The Media may not be resold, relicensed, or sub-licensed.
    • 2. Title and ownership, and all rights now and in the future, of and for the Media remain exclusively with the Content Provider.
    • 3. There are no warranties, express or implied. The Media are provided ‘as is.’
    • 4. Neither Content Provider nor Alexis Giostra (designer) will be liable for any third party claims or incidental, consequential or other damages arising out of this license or buyer’s use of the Media.
    • 5. It is the responsibility of the buyer to download, access, and save their purchase within a reasonable period of time to ensure ongoing access. Purchases made over two years prior will not be restored, and dated or time sensitive products/offers will not be restored outside of their prescribed time frame.

*With exception of date or time sensitive products/offers and files which are intended for use during their prescribed time frame. Digital manipulation of date sensitive products is strictly prohibited.

REFUNDS & CUSTOMER SATISFACTION

Due to the digital and/or virtual nature of the products sold on this site, no refunds or exchanges are permitted. Please make sure to read through product descriptions carefully, visit the Frequently Asked Questions Page for additional details, and email us if you have any questions. Customer satisfaction is of the utmost importance to us, and although we do not accept refunds on our digital products or services, if you are experiencing any unforeseen issues with your purchase, please notify us via email immediately and we will work directly with you to resolve your issue.

CONSENT

In purchasing from this site, buyer acknowledges that they are at least the legal age of consent within their municipality or acknowledges that they have the express permission of a legal guardian to enter into the Personal Use License Agreement and accept all additional disclaimers that apply to their purchases.

CHANGES TO THIS POLICY

Alexis Giostra and Charmed Media Enterprises LLC reserve the right to modify this policy at any time. Any changes or modifications to this policy take effect immediately upon publishing to this site without notice. Any material changes will be be communicated to license holders via email.
